1. Acceptance of Terms

Welcome to Hammer Ai (referred to herein as "Hammer Ai", "we", "us", or "our"), accessible at eng-hammerai.com, including all affiliated subdomains, desktop applications, mobile interfaces, and programmatic APIs. By navigating, registering, accessing, downloading, or engaging with our platform and synthetic artificial intelligence companions, you ("User", "you") confirm that you have read, comprehended, and agreed to be legally bound by these Terms of Service ("Terms") in full.

If you do not consent to all provisions set forth in this agreement, you are strictly prohibited from using Hammer Ai and must immediately discontinue access to all related web portals, software applications, and network services.

2. Age Eligibility & Adult Content Mandate (Strictly 18+)

Mandatory Age Restriction: Hammer Ai is an uninhibited conversational, romantic, and mature fantasy simulation engine exclusively designed for consenting adults. You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction of residence, whichever is higher, to create an account or use our platform.

By accessing Hammer Ai, you represent and warrant under penalty of perjury that:

3. Nature of Synthetic AI Companions

Hammer Ai provides users with generative natural language processing engines, vector-based episodic memory frameworks, multimodal synthetic voice generation, and photorealistic AI image rendering. You explicitly recognize and acknowledge the following parameters of the service:

  • Artificial & Fictional Characters: All personas, companions, characters (including Sister Patience, Cora, Toji, Scarlett, and user-generated custom bots) are entirely synthetic, computer-generated constructs powered by probabilistic algorithms. They do not possess consciousness, sentience, real feelings, or moral autonomy.
  • Entertainment Purpose: Hammer Ai services are intended exclusively for creative writing, fantasy roleplaying, emotional simulation, and adult entertainment. They do not constitute professional medical, psychological, psychiatric, relationship, legal, or financial counseling.
  • Generative Variability: Generative models produce outputs probabilistically based on prompts. While our fine-tuned engines strive for continuity, Hammer Ai does not guarantee the factual accuracy, consistency, or appropriateness of any simulated message, voice clip, or image output.

4. User Accounts, Registration & Credential Security

When creating a Hammer Ai account, you must provide accurate, current, and verifiable information where prompted. You bear absolute responsibility for maintaining the confidentiality of your credentials, passwords, cryptographic keys, and active sessions.

You agree to notify Hammer Ai immediately upon discovering any unauthorized entry into or breach of your account. Hammer Ai will not be liable for any damages, losses, or data corruption arising from your failure to protect your login identifiers. Accounts may not be transferred, shared, or resold to any third party under any circumstances.

5. Acceptable Use & Prohibited Conduct

While Hammer Ai operates with unfiltered adult creative dialogue, we maintain non-negotiable boundaries to ensure ethical compliance, safety, and legal operation. You agree not to engage in or attempt any of the following prohibited behaviors:

  • Zero Tolerance for Child Exploitation: Creating, uploading, prompting, simulating, or generating content involving the sexualization, abuse, or exploitation of minors (CSAM/CSAE) in any text, visual, or audio format. Any violation results in immediate permanent ban and direct referral to the National Center for Missing & Exploited Children (NCMEC) and relevant legal jurisdictions.
  • Non-Consensual Real-Person Representations: Generating explicit synthetic media, deepfakes, or erotic representations depicting real-world living individuals, celebrities, or non-consenting public figures.
  • Extreme Harm & Violence: Prompting, generating, or facilitating depictions of severe non-consensual violence, suicide encouragement, self-harm instructions, terrorism, hate speech against protected classes, or acts of mass violence.
  • Platform Attacks & Scraping: Reverse engineering, decompiling, scraping, crawling, distributed denial-of-service (DDoS) attacks, or bypassing safety protocols, rate limits, and server firewalls.
  • Commercial Exploitation: Reselling synthetic chat access, automating spam bots, or redistributing generated companion assets for commercial SaaS exploitation without explicit written authorization.

6. Discrete Billing, Subscriptions & Refund Policy

Hammer Ai offers both free tiers and premium membership tiers (VIP Access) providing unrestricted message velocity, high-resolution media generation, custom companion creation, and voice synthesis.

  • Discrete Billing: To honor your privacy, charges billed to your credit card or financial institution will appear under neutral, discrete merchant descriptors that do not mention "Hammer Ai", "AI Dating", or explicit romantic services.
  • Recurring Subscriptions: Paid subscriptions automatically renew on a monthly or annual billing cycle unless canceled through your account dashboard prior to the scheduled renewal timestamp.
  • Refund Policy: Due to the immediate computation, GPU server costs, and token allocation involved in real-time generative AI inference, all digital subscription fees and token bundles are non-refundable once activated, except where explicitly required by mandatory regional consumer protection laws.

7. Intellectual Property & Output Ownership

Platform Assets: The Hammer Ai trademark, brand logos, user interface designs, custom stylesheets, proprietary backend neural wrappers, software code, and curated default companion rosters remain the sole intellectual property of Hammer Ai Global Network.

User Content & Generated Dialogue: Subject to your adherence to these Terms, you retain intellectual property rights to your original creative prompt inputs. Between you and Hammer Ai, you own the conversational outputs generated during your personal interactive sessions. You grant Hammer Ai a non-exclusive, worldwide, royalty-free, limited technical license strictly to process, execute, and store your inputs and outputs to deliver the real-time service to your authenticated account.

8. Privacy & Zero-Telemetry Principles

Your confidentiality is paramount. Hammer Ai enforces high-standard client-side encryption and zero-telemetry protocols. We do not sell user interaction records, utilize private adult conversations to train open public foundation models, or inspect unflagged private dialogues. 9. Disclaimers of Warranties & Limitation of Liability

"AS-IS" AND "AS-AVAILABLE": THE HAMMER AI SERVICES, INTERFACES, CHARACTERS, IMAGES, AND VOICES ARE PROVIDED STRICTLY ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR COLLATERAL, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR UNINTERRUPTED AVAILABILITY.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL HAMMER AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, EMOTIONAL DISTRESS, OR SERVICE INTERRUPTIONS ARISING OUT OF THE USE OR INABILITY TO USE THE PLATFORM. IN NO EVENT SHALL HAMMER AI'S TOTAL AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO HAMMER AI IN THE PRECEDING SIX (6) MONTHS, OR FIFTY UNITED STATES DOLLARS ($50.00 USD), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Hammer Ai, its affiliates, directors, contractors, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from: (a) your use or misuse of the platform; (b) your violation of these Terms; (c) your breach of any third-party intellectual property or privacy right; or (d) any unlawful prompts or inputs transmitted through your account.

11. Governing Law, Dispute Resolution & Binding Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Mandatory Individual Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or your use of Hammer Ai shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You expressly waive any right to initiate, participate in, or join any class action lawsuit, collective arbitration, or private attorney general representative action against Hammer Ai.

12. Account Termination & Suspension

Hammer Ai reserves the absolute right, without prior notice or liability, to suspend, terminate, or restrict your access to any part of the service if you violate these Terms, breach statutory laws, or engage in behavior deemed detrimental to the safety of our infrastructure, communities, or models. You may discontinue your account and delete your stored companion histories at any time through your account preferences panel.
